SAGINAW, Mich. (Michigan News Source) – A lawsuit has been filed against Saginaw Township Community Schools and several administrators after a custodian allegedly gave an 8-year-old girl “birthday spankings” and pinched her backside in May.

The suit alleges the custodian spanked the second-grade student at Hemmeter Elementary School in the bathroom. Cameras are not in the bathroom, so the alleged incident was not recorded. The custodian has been placed on administrative leave.

Neither the custodian nor the child’s legal names are mentioned in the suit, but only referenced as “Jane Roe” and “Minor Doe,” respectively.

The lawsuit alleges the girl was walking through the hallways on the way to the restroom when she encountered the custodian. The girl told her it was her eighth birthday, prompting the custodian to ask her if she wanted her “‘birthday spankings’ now or at lunch.”

When the girl said she would not be at lunch, the custodian said she would have to get her spankings now. The suit alleges the custodian then followed the girl into the restroom where she spanked her eight times and pinched her buttocks.

The suit seeks more than $75,000 in damages, costs, interest, and attorney fees.
