EAST LANSING, Mich. (Michigan News Source) – Mel Tucker is not leaving Michigan State University quietly. An attorney for the now fired head football coach is asking MSU to preserve all documents related to the investigation “in anticipation of litigation” against the university.

Tucker’s attorney sent the request on Thursday and called this week’s firing an “illegal termination of Mel Tucker’s contract.” The preservation of those documents includes both paper and electronic, and the request also named several school officials.

The request came one day after MSU fired Tucker over what he says was consensual phone sex with rape survivor and Set the Expectation founder Brenda Tracy.  She claimed it was a flirtatious friendship that went too far in April 2022 after the two worked together in the aftermath of the Larry Nassar scandal. Tracy filed a complaint with the school’s Title IX office in December 2022 and it wrapped up its investigation on July 25.

News of the story broke earlier this month after USA Today published an article. MSU appeared to act swiftly, first suspending Tucker without pay on September 10. The following week, MSU said it would begin the process of termination. That was finalized on Wednesday.

In addition, MSU terminated what’s left of Tucker’s $95 million, 10-year contract. The school said he breached his contract because of “moral turpitude.”

The request from Tucker’s legal team is not without merit. MSU still has not turned over 6,000 pages of documents to Michigan Attorney General Dana Nessel related to the Nassar scandal. The school cited “attorney-client privilege” and Nessel has given up her investigation.
