EAST LANSING, Mich. (Michigan News Source) – Prominent rape survivor and anti-sexual assault advocate Brenda Tracy filed an intent-to-sue notice against Michigan State University (MSU), its governing body, and disgraced former head football coach, Mel Tucker.

The filing on behalf of Tracy and her nonprofit “Set the Expectation” is a mandatory precursor to filing a lawsuit against a government agency.

Tracy case argues that Tucker’s sexual harassment of her and his release of her private text messages violated the confidentiality of the Title IX allegations filed against him in December 2022. In addition, Tracy’s legal action tied to what she argues is damage to her reputation, her organization, and charitable work.

Tracy is seeking $50 million in personal damages and $25 million for her nonprofit for a range of claims.

In December 2022, MSU started looking into Tracy’s claims that her work with Tucker and her organization resulted in a friendship. That crossed the line, she said, during a phone conversation in April 2023. Tucker claims it was consensual phone sex.

MSU received the report last July, and by September, Mel Tucker had been placed on administrative leave pending an investigation. MSU fired him several weeks later.
