LANSING, Mich. (Michigan News Source) – Is it a crime to enter the United States illegally?
That’s a question being raised by opponents of President Donald Trump’s immigration policy.
“That is your opinion.”

The Michigan Republicans released a video recently of Yvonne Navarrete of We The People Action Fund in which Navarrete disputes that it is a crime to be in the U.S. as an undocumented immigrant.
In the video, State Sen. Jim Runestad (R-White Lake) takes note that during a legislative hearing Navarrete wasn’t distinguishing between migrants and illegal migrants.
“She said it is not a crime to be here illegally. It is a crime,” Runestad said.
“That is your opinion,” Navarrete said repeatedly.
That was not the first time someone questioned whether it was a crime to enter the U.S. illegally.

In March, Rep. Jasmine Crockett (D-Texas) appeared on a talk show and said it’s “not a crime” to enter the country illegally. Crockett said it was a civil violation and not a criminal violation illegally.

However, legal websites cite 8 USC 1325(a) as the law that provides criminal penalties for a non-resident who enters the U.S. illegally by imprisonment for up to 6 months and/or a fine up to $5,000.
Zavala Law, a law firm that specializes in immigration, based in Austin, Texas, also confirmed it is a crime to enter the U.S. illegally.
“Fortunately, for immigrant applicants who entered the U.S. illegally, the U.S. government has rarely filed criminal charges against anyone for illegal entry, which has been a decades long government practice during both Republican and Democrat administrations, and will likely remain the prevailing government practice given the prohibitive costs of prosecution, incarceration and/or collecting fines,” the law firm stated on its website.
