GRAND RAPIDS, Mich. (Michigan News Source)  – Opening arguments are underway Wednesday against two men that federal prosecutors say lead the 2020 effort to kidnap Gov. Gretchen Whitmer.

One prosecutor told jurors they get a second opportunity to convict Adam Fox and Barry Croft, Jr. after another jury couldn’t reach a unanimous verdict on the charges in April. However, that jury did acquit two other men and two more pleaded guilty.

Defense attorneys are expected to argue no actual conspiracy ever existed, and will question the integrity of undercover F.B.I. agents who they said infiltrated the group and built the investigation.

This jury, which was selected earlier this week, said they know very little about the high-profile case.

Chief U.S. District Judge Robert Jonker told the prospective jurors that the case is “potentially more challenging” than other trials since the victim is the sitting governor and a previous trial ended with no convictions against the two men.

Jonker emphasized to the jury that the government is “entitled to a fair trial, just as the defendants are.”
