LANSING, Mich. (Michigan News Source) – Michigan Republicans are pushing back against proposed legislation making its way through Lansing that would add “Red Flag” laws to the books.

The bills would create extreme risk protection orders (ERPOs), also called “red flag” laws, and would allow law enforcement to take weapons from anyone that another person reports as “reasonably likely” to injure themselves or others with a firearm.

Rep. Bryan Posthumus (R-Kent County) opposes the legislation. “This legislation turns ‘innocent until proven guilty’ on its head,” he said. “In America, we have the right to bear arms and to due process. This legislation robs Michigan gun owners of those rights.”

Rep. Andrew Beeler (R-Port Huron) stands with Posthumus. “Red flag laws are an unprecedented change to how our legal system operates, he said. “They allow the courts to take away… a law-abiding citizen’s property and right to self-defense, when the person has committed no crime — and without any other substantiated cause,” said Beeler “Michiganders do not want our government to take away rights based on mere suspicion.”

Rep. Jaime Greene (R-Richmond) offered similar sentiments. “A vindictive former roommate or a scorned ex would be able to file for one of these orders and strip someone of their Constitutional rights,” Greene said. “Meanwhile, the person losing their rights has no guarantee that they will be given an opportunity to face their accuser or a right to representation from an attorney if they cannot afford one.”

The Democrat-controlled legislature is moving quickly to bring more gun control to the state of Michigan after Gov. Gretchen Whitmer signed legislation on Thursday that requires stricter safe storage laws and universal background checks.
