YPSILANTI, Mich. (Michigan News Source) – A 30-year-old man from Ypsilanti is facing federal charges after allegedly pulling a dangerous stunt on I-96 that disrupted a Border Patrol transport operation and nearly caused a crash.

Jacob Nathaniel Len, 30, has been charged with forcibly resisting, impeding, intimidating, or interfering with Border Patrol agents after a July 7 incident in Oakland County near the Kensington Road exit. According to a criminal complaint filed by the U.S. Attorney’s Office for the Eastern District of Michigan, Len’s reckless driving put federal agents, detainees, and the public in harm’s way.

The chaos began when two marked U.S. Border Patrol vehicles carrying 15 detained “illegal aliens” – were headed westbound on I-96 near Brighton. The officers were taking the individuals from the Gibraltar Border Patrol Station to the North Lake Correctional Facility in Baldwin.

Authorities say Len approached the convoy in a BMW at approximately 6 pm on July 7, made an obscene gesture toward the agents, and then aggressively merged into their lane without signaling.

He then cut directly in front of the transport van and slammed on the brakes, forcing both Border Patrol vehicles to brake hard to avoid a crash. Len reportedly repeated the move again before exiting the freeway.

The agents, because of policy and also concern for the safety of everyone in the vehicles, did not pursue Len. The affidavit says, “Due to the sudden braking, the immigrant detainees slammed against the interior walls in the back of the van.” The Border Agents stopped at the first available offramp to check on the well-being of the detainees but found that none had been injured. Agents in both vehicles called 911 to give them information on the incident and Len’s license plate number to pass along to local law enforcement.

Federal officers interviewed Len on July 30 outside of the residence listed on his driver’s license. Len confirmed he drove a black BMW sedan on I-96 on July 7 and “flicked off” the Border Control vehicles. He first denied brake checking the Border Patrol transport van but later admitted that brake checking the vehicles could have hurt the occupants inside.

Federal officials call behavior “shameful.”

United States Attorney Jerome F. Gorgon, Jr., stated: “The alleged actions of this man are shameful. While zipping around in his BMW, this defendant cavalierly endangered the hardworking agents who put their lives on the line every day protecting our country, the illegal aliens they were tasked with safely transporting, and other drivers going about their lives.”

Cheyvoryea Gibson, Special Agent in Charge of the FBI Detroit Field Office said, ”Interfering with a federal agent performing their official duties is a serious criminal offense and will not be tolerated. The alleged actions by Jacob Len were not only reckless, but endangered lives and compromised public safety. I would like to thank the dedicated members of our FBI Ann Arbor Resident Agency for their thorough work with this investigation.”

Len released on bond, hearing set.

Len was arrested on August 1 and appeared in federal court in Detroit August 4. He was released on bond and is scheduled to appear again on August 25 for a preliminary hearing. Special agents from the FBI are investigating.

The charge of impeding federal officers is a felony. If convicted, Len could face prison time and fines.
