The Trump administration’s EO.
In February, President Donald Trump signed an executive order that banned males from playing in female sports. In 2023, Democrats amended the Elliott-Larsen Civil Rights Act to include sexual orientation, gender identity and expression as a protected class.
Michigan High School Athletic Association (MHSAA) Spokesman Geoff Kimmerly stated that Michigan has conflicting state and national laws addressing transgender athletes in sports.
“As we have stated since February, Michigan has a clear legal conflict between state civil rights law (Elliott-Larsen) and the February Federal Executive Order,” Kimmerly said in an email to Michigan News Source. “We have continued to await clarification on how these conflicts should be reconciled, which we understand will be addressed by a case before the United States Supreme Court later this fall.”
What about Michigan sports?
The MHSAA reviews transgender athletes eligibility on a case-by-case basis and has stated it is a very rare occurrence.
