WASHINGTON (Michigan News Source) – The U.S. Department of Education restored Title IX to its original intent on Monday, which prohibits education programs that receive federal funding from discriminating on the basis of sex. In addition to education, Title IX also covers female students’ rights to privacy in bathrooms, locker rooms, and a competitive athletic environment with other biological females.

Republican U.S. Congressman Tim Walberg of Michigan serves as the Education and Workforce Committee Chairman. He applauded the move.

“Title IX was enacted to prohibit discrimination on the basis of sex and to ensure equal access to educational opportunities,” said Chairman Walberg. “Schools need rules that are understandable, workable, and consistent with the law.” He added, “Returning to the 2020 regulations restores longstanding protections for women and girls that the Biden-Harris administration attempted to dismantle and realigns Title IX policy with court precedents.”
“Commonsense Language”
Monday’s action follows a January 2025 federal court decision which upended the Biden-Harris administration’s 2024 Title IX regulations. U.S. Secretary of Education Linda McMahon said the restoration of Title IX provides clear guidance while championing the rights of girls and women.
“Today’s rulemaking clears the Biden Administration’s illegal rewrite of Title IX from the Code of Federal Regulations and restores the commonsense language promulgated in the first Trump Administration, which we have been enforcing since the first days of the Administration,” she said. “Thanks to today’s action, the published Title IX regulations faithfully reflects court orders and Congressional intent—reducing confusion for parents, students, and educational institutions. We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls.”
The Biden Administration’s Office for Civil Rights (OCR) pushed the nation’s schools to allow males to intrude into women’s sports competitions, locker rooms, and bathrooms. The Biden-Harris administration also punished coaches, teachers, and staff for using incorrect pronouns or discussing preferred genders.
In Michigan, the Michigan High School Athletic Association (MHSAA) governs high school athletics in the state. They provide waivers for males to play in females’ sports; officials previously said they cannot change that policy until the Michigan legislature does so.
