BRIGHTON, Mich. (Michigan News Source) – It’s a story that has remained largely unnoticed with no significant coverage from major Michigan media outlets. However, records from the 44th Circuit Court of Livingston County reveal that 26-year- old illegal immigrant Alan Nievas-Garnica has pled guilty to third-degree criminal sexual conduct for an offense against a 15-year-old girl that happened within the county on October 22, 2023.

The age and sex of the victim was also confirmed by the Green Oak Charter Township Sheriff’s office in Brighton.

Sentence is 18 months to 15 years.

The case, which was investigated in Green Oak Charter Township, resulted in the defendant pleading guilty, followed by Nievas-Garnica receiving a prison sentence on February 15th. The sentence ranges from eighteen months to a maximum of 15 years – with a credit of 114 days served. His earliest release date could be April 23, 2025 and the maximum discharge date is October 23, 2038.

Nievas-Garnica is currently in prison in Jackson in a facility called the “Charles E. Egeler Reception & Guidance Center.” It states on their website that it “serves as a quarantine facility responsible for intake processing of all male offenders who are adjudicated adults sentenced to a term of incarceration with the Michigan Department of Corrections. Prisoners with new commitments and parole violators are received at RGC for assessments, screening, and classification prior to their placement in general population prisons.”

There is no mugshot for Nievas-Garnica’s which has his biographical information on the MDOC Department of Corrections website but it lists him as being Hispanic, 5’4”, 132 lbs with body piercing in the center of his tongue and left ear, a scar above his eyebrow and tattoos on his left bicep and left hand. He has no known aliases.

What is third-degree criminal sexual conduct?

His charge, third-degree criminal sexual conduct third degree person 13-15, is a felony and covers different situations when a person engages in sexual penetration with another person in circumstances which include: if force or coercion is used, or if the victim is mentally incapacitated or physically helpless and what is commonly referred to as “statutory rape.”

Independent reporter Dave Bondy, who recently reported on Nievas-Garnica’s sentencing, said that Judge Michael Hatty had asked Nievas-Garnica in court if he was a citizen of the United States and he responded by saying “no.”

Bondy further notes in his reporting that at Nievas-Garnica’s sentencing, that the victim’s parents expressed their frustration about Nievas-Garnica’s illegal presence in the United States through a letter read in court.

The immigration status of Nievas-Garnica has also been verified by Livingston County Sheriff Michael Murphy who appeared on the Steve Gruber Show on March 4th.

When Gruber asked Sheriff Murphy if the open borders were impacting his department, he answered, “Yes, as a matter of fact it is. We thought we would be immune to this being a midwestern state, center of Michigan, here in southern Michigan, but we’re not. We just recently had a case handled by a local police agency…it was the criminal sexual conduct of a a 15-year-old by an illegal so we are not immune to this, nobody is immune to this.”

Sheriff Murphy also confirmed to Gruber that the defendant would be deported once he finishes out his prison term.

Information on the 44th Circuit Court’s website reveals that as a condition of his plea deal and sentencing that Nievas-Garnica must waive confidentiality and give his medical test records to the court including HIV testing. He also has to complete counseling associated with HIV and AIDS and register as a sex offender as required by the state.

Additionally, records show that Nievas-Garnica had to submit his DNA, he forfeited his vehicle and he was afforded a Spanish interpreter during his court proceedings. He was also ordered to pay a total of $808 in fines including $130 for “crime victims rights.”

According to Michigan legislation, the Crime Victims Rights Act prescribes that “persons convicted of any felony or misdemeanor pay a fee to the court which is transmitted to the state Crime Victims Rights Fund. The purpose of the fund is to both reimburse victims for expenses they incurred related to the crime which were not already reimbursed through insurance or restitution and fund a statewide trauma system. For an adult felony conviction, the defendant must pay $130. For an adult misdemeanor conviction, the defendant must pay $75. For a juvenile finding or determination, the juvenile must pay $25.”
